Your Legal Rights When You’ve Been Hurt
Unlike many states, New Jersey relies on a strong mass transit system to accommodate the needs of its citizens. In addition to serving the state’s largest cities, New Jersey’s mass transit system connects people to New York City and Philadelphia. While the NJ mass transit system is generally considered safe, the overall rate of motor vehicle accidents tends to be higher in New Jersey than in most other states because of the population density.
What are your rights if you’ve been injured in a bus, train, or light rail accident in New Jersey?
Common Causes of Mass Transit Accidents in New Jersey
A number of factors can increase the likelihood of a mass transit accident in New Jersey:
- Sudden stops or starts by mass transit vehicle operators, causing passengers to be thrown down or against a stationary object
- Driver negligence, including distracted driving, driving under the influence, and other traffic law violations
- Mechanical breakdowns, including brake problems, steering malfunctions, and tire issues
- Overcrowded platforms or vehicles
- Increased traffic on the roadways, including a greater number of buses and other mass transit vehicles
Your Rights When You’ve Been Hurt in a Mass Transit Accident in New Jersey
Your legal recourse after a mass transit accident depends, in part, on who caused the crash. If the accident was caused by the wrongful act of a private individual—the driver of another vehicle, for example—you have the same rights you would have in any other car, truck, or motorcycle accident. You can file a personal injury lawsuit in civil court but must do so within the period of time set forth in the statute of limitations. You have the right to seek damages for lost wages and income, pain and suffering, unreimbursed medical expenses, loss of companionship or consortium, loss of enjoyment of life, and damage to or loss of personal property.
If, however, the accident was caused by the carelessness or negligence of a municipality or its employee, you must file your claim under the New Jersey Tort Claims Act. Such claims must be filed within 90 days of the date of the accident.
